Terms of Use
Effective Date: June 1, 2026
The following Terms of Use (“Terms”) govern your use of the Xome websites, mobile applications, and digital products and services (“Sites”), including Xome.com and ValueYourHome.com, content, products and services (“Services”) of Xome Inc. and its affiliates (“Xome”) on behalf of the brokerage (“Broker”) that are made available in the United States and its territories and possessions.
READ THESE TERMS CAREFULLY BEFORE USING OR ACCESSING OUR SERVICES.
By accessing, downloading, installing, running, or using any of these Services, you agree to be bound by these Terms, as updated from time to time. If you do not agree to our Terms, you should not access or otherwise use the Services. Any continued use of our Services after changes or updates have been made to these Terms constitutes your acceptance of such changes. The terms “you” shall refer to you the user, and the terms “we,” “us,” or “our” shall refer to Broker and/or Xome. The following conditions apply:
License. For as long as you remain compliant with all Terms as set forth herein, Xome grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include any right to resell or commercially exploit our Services or their contents; collect and use any property listings, descriptions, or prices; make any derivative use of our Services or their contents; download or copy account information for the benefit of another merchant; or use data mining, robots, or similar data gathering and extraction tools. This license is immediately revoked upon any breach of these Terms.
- Restrictions on Use. You agree that you will not engage in any of the following prohibited activities in connection with your use of the Services: (a) copying, distributing, or disclosing any part of the Services in any medium; (b) using any automated system, including “robots,” “spiders,” or “offline readers,” to access the Services; (c) transmitting spam, chain letters, or other unsolicited email; (d) attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services; (e) uploading invalid data, viruses, worms, or other software agents through the Services; (f) collecting or harvesting any personally identifiable information, including account names, from the Services; (g) using the Services for any commercial solicitation purposes without our prior written consent; (h) impersonating another person or otherwise misrepresenting your affiliation with a person or entity; (i) violating applicable laws or regulations; or (j) accessing content on the Services through any technology or means other than those provided or authorized by us.
- Eligibility. You represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. Our Services are intended for use within the United States and its territories. You further agree that you are not a resident of the European Union nor will you use our Sites and Services while present in the European Union. Note: While the foregoing provision is intended to limit access to EU residents, it does not constitute a technical bar to EU access and does not guarantee inapplicability of the EU General Data Protection Regulation (GDPR). Xome does not currently offer services designed for EU consumers. If you are accessing our Services from the European Union, you do so at your own risk and acknowledge that certain EU data protection rights may not be available through our Services. Xome is evaluating additional technical and legal measures to address EU user access.

Your Account.
To access certain features of the Services, you may be required to register for an account. You agree to provide
accurate, current, and complete information during registration and to update such information as necessary to keep it
accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all
activities that occur under your account. You agree to notify us immediately at
[email protected] of any unauthorized use of your account or any
other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.
We maintain account records, including your name, telephone number, email address, and username, for operational and compliance purposes. For security purposes, passwords are stored using industry-standard one-way cryptographic hashing algorithms (such as bcrypt or Argon2) and are never stored in plaintext. Where record retention of hashed credential data is required by applicable MLS rules or contractual obligations, such data is retained for no longer than 180 days following account expiration or password reset, and is subject to our data security program consistent with the FTC Safeguards Rule (16 C.F.R. Part 314).

Property Listings and Data.
Property listing data available through our Services is provided for informational purposes only. We make no
representations or warranties regarding the accuracy, completeness, or timeliness of any property listing data. Property
listing data may be available from us through other means and, in certain instances, may include additional data where a
seller has opted not to display its property through our Services. We reserve the right to remove or modify property
listing data at any time.
Inaccurate Data. In the event you find any property listing data or information that you believe to be inaccurate, please contact us at [email protected]. We will use commercially reasonable efforts to investigate and correct inaccurate data in a timely manner, subject to applicable MLS rules and data provider requirements.
Property Record Removal Requests: Xome receives and displays property listing and related data sourced from publicly available local taxing and property records from county assessors and recorders’ offices throughout the nation. Because this data is publicly available, Xome does not remove individual property records from its platform upon request. If you believe property data displayed on our Services is erroneous, the most effective remedy is to contact your local property assessor or recording office directly — in many cases, the same information can be viewed and corrected online through your local assessor’s or recorder’s website. Once corrected at the source, Xome’s data will update in the ordinary course of our data refresh cycle. For questions about a specific property record, please contact us at [email protected].
California Digitally Altered Image Disclosure (California AB 723, effective January 1, 2026): For property listings displayed on our Services where the listing broker or agent has submitted digitally altered images (including AI-generated additions of furniture, landscaping, structural modifications, or altered views or neighboring structures), Xome requires listing brokers to include a disclosure identifying the alteration and providing a link or QR code to the unaltered original image, or to display both the unaltered and altered versions side-by-side. Standard photo editing that improves image clarity without altering property substance is permitted without disclosure. This requirement applies to listings accessible to California consumers.
Trigger Lead Prohibition (Homebuyers Privacy Protection Act, effective March 5, 2026): Xome does not purchase or use “trigger leads” — consumer credit inquiry data sold by credit reporting agencies to competing lenders following a mortgage application — for marketing purposes. This practice is prohibited under the Homebuyers Privacy Protection Act (amending 15 U.S.C. § 1681 et seq.).
MLS Private Listing Designation (NAR Clear Cooperation Policy, revised September 30, 2025): Sellers may now elect a “private listing” designation to opt out of MLS syndication to third-party platforms. Xome honors private listing designations and does not syndicate or display listings where the seller has elected private status.

Automated Valuation Estimates (AVM) Disclaimer.
Xome provides automated property valuation estimates through its Xome Valuation Model (XVM) and through the
ValueYourHome.com platform. THE FOLLOWING DISCLAIMER APPLIES TO ALL AVM ESTIMATES DISPLAYED ON OUR SERVICES:
AUTOMATED VALUATION DISCLAIMER: All property value estimates displayed on Xome.com, ValueYourHome.com, and any other Xome platform are generated by Xome’s Automated Valuation Model (XVM), a statistical and machine-learning algorithm. These estimates are provided for informational and research purposes only. They ARE NOT real estate appraisals conducted by a licensed appraiser, and they SHOULD NOT be relied upon as a substitute for a professional property appraisal. Actual property values may differ materially from XVM estimates. XVM estimates are not intended for use as the sole basis of any lending, investment, or financial decision. Xome does not guarantee the accuracy of XVM estimates. For any transaction involving real property, you should obtain an independent appraisal from a licensed appraiser.
The XVM is subject to the federal Quality Control Standards for Automated Valuation Models (Dodd-Frank Act § 1473; effective October 1, 2025). Xome implements quality control procedures to protect the integrity of valuation data and to comply with applicable fair lending and fair housing laws. For additional disclosures regarding automated decision-making technology, please review our Privacy Policy.
The existing Disclaimer of Warranties in Section 12 of these Terms also applies to AVM estimates and all other content provided through our Services.
FTC AI Policy Statement (March 11, 2026): The FTC has clarified in its March 2026 Policy Statement that Section 5 of the FTC Act applies to AI systems. Xome complies by: (1) making truthful and substantiated claims about XVM accuracy; (2) disclosing material limitations; (3) not presenting AI valuations in misleading ways. General AI disclosure: “This tool uses artificial intelligence. AI-generated estimates have limitations and should be verified independently before use in financial decisions.”
AI-Generated Content Disclosure: Property descriptions, virtual tours, and other content generated or modified using artificial intelligence on our Services are identified as AI-generated where required by applicable law, including the FTC March 2026 Policy Statement and California SB 942 (effective August 2, 2026 for California users). AI-generated or digitally altered property images are disclosed pursuant to California AB 723 (effective January 1, 2026).
3rd-Party AVM Supplements: Where the Xome Valuation Model (XVM) does not have sufficient data to generate a reliable estimate for a specific property, Xome may display a valuation estimate sourced from a purchased third-party automated valuation model (AVM) provider. Third-party AVM estimates are subject to the same disclaimer as the XVM set forth above: they are not appraisals, are provided on an “AS AVAILABLE” and “AS IS” basis, and should not be relied upon as a substitute for a professional property appraisal. Third-party AVM providers are contractually required to meet applicable quality control standards consistent with the federal AVM QC Standards Rule (Dodd-Frank Act § 1473; effective October 1, 2025).

User Submissions and Intellectual Property.
Our Services may permit you to submit, upload, publish, or otherwise make available content, including property
information, photos, and comments (“Submissions”). You retain ownership of your Submissions, but by
providing them you grant Xome a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce,
modify, adapt, publish, and distribute your Submissions for purposes of operating and improving our Services and,
where applicable, to provide the same to the relevant MLS.
Xome and its licensors own all intellectual property rights in our Services, including software, databases, trademarks, and MLS data compilations. No rights in Xome’s intellectual property are granted to you except as expressly stated in these Terms.

Payments and Refunds.
Certain Services are offered for a fee. By purchasing a Service, you agree to pay all applicable fees as described at
the time of purchase. All fees are in U.S. dollars. You may cancel your purchase by e-mail to
[email protected] or by phone at (800) 758-8052. Your purchase will
not be considered canceled until you receive a confirmation from us via email or telephone.
Refunds are NOT available more than 24 hours after purchase, except where required by applicable state law. Certain state consumer protection laws may provide additional refund rights beyond those described here; nothing in these Terms limits any rights you may have under applicable state law. To request a refund within the applicable period, contact [email protected] or call 1-844-354-9111. We will not provide refunds on the grounds of a temporary service failure that has been remediated.

Copyright and DMCA Policy.
We respect the intellectual property rights of others and expect users of our Services to do the same. If you believe
that content available through our Services infringes a copyright you own or control, please send a written notice of

- Privacy. Please review our Privacy Policy, available at xome.com/pages/privacy-policy and valueyourhome.com/privacy. The Privacy Policy governs our collection, use, and disclosure of your personal information and explains your privacy rights, including rights under the California Consumer Privacy Act (CCPA), state privacy laws, and your rights regarding automated decision-making technology. By using our Services you acknowledge that you have read and understood the Privacy Policy.
- Electronic Communications. When you use our Services, you are communicating with us electronically. You expressly consent and opt in to receive service-related communications from us electronically, including via e-mail, in-app notifications, or other electronic means. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communication be in writing. Applicable law and the laws of the State of Texas, without regard to its principles of conflict of laws, will govern these Terms and any dispute that might arise between you and Xome.

SMS and Telemarketing Communications.
SMS/Text Messaging Program. Xome offers an optional SMS/text messaging program to keep you informed about property updates, service notifications, and, with your separate consent, marketing offers.
Service-Related SMS: By providing your mobile phone number and using our Services, you consent to receive non-marketing, service-related text messages from Xome, such as account notifications and property status updates.
Marketing SMS / Telemarketing: Your consent to receive marketing text messages, telemarketing calls, or messages sent using an automatic telephone dialing system or pre-recorded voice is SEPARATE from your acceptance of these Terms. Marketing SMS consent must be obtained through a standalone written consent mechanism at the point of data collection, independent of acceptance of these Terms of Use. Acceptance of these Terms alone does NOT constitute prior express written consent to receive marketing texts or autodialed/pre-recorded calls under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and FCC regulations (47 C.F.R. Part 64).
Message Frequency and Opt-Out: Message frequency varies. Standard message and data rates may apply. To opt out of SMS messages at any time, reply STOP to any message we send. To receive help, reply HELP. You may also opt out by contacting us at [email protected] or calling (800) 758-8052. Opt-out requests will be honored immediately in accordance with the FCC TCPA Opt-Out Rule (effective April 11, 2025). Opting out of marketing SMS will not affect your receipt of service-related communications.
Call Recording: Any calls made through our Xome Concierge service may be recorded or monitored for quality assurance purposes. By making such a call you consent to the recording and monitoring.
Canadian Users / CASL: If you are located in Canada, we will obtain your express opt-in consent before sending you commercial electronic messages, in compliance with Canada’s Anti-Spam Legislation (CASL), S.C. 2010, c. 23. Acceptance of these Terms does not constitute CASL consent for commercial messages. Canadian users may withdraw CASL consent at any time by contacting [email protected].
TCPA Compliance Update — Critical April 2026 Deadline: Effective April 11, 2025, we honor seven standardized opt-out keywords (STOP, QUIT, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE, END) for all SMS/text programs. EFFECTIVE APRIL 11, 2026 — FCC “Revoke-All” Provision: If you opt out of one message type from Xome, your opt-out will apply to ALL marketing robocalls and robotexts from Xome unless you specifically indicate otherwise at the time of opt-out. We have implemented cross-platform revocation tracking systems to comply with this requirement. To opt out of all Xome marketing SMS and calls, reply STOP or say “STOP” to any automated call, and your revocation will be honored across all Xome programs. Penalty for TCPA violations: $500–$1,500 per message.

THE SERVICES, INCLUDING ALL CONTENT, PROPERTY LISTINGS, AND PROPERTY VALUATION ESTIMATES, ARE PROVIDED “AS IS”
WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR
A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. XOME DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED,
ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AVM ESTIMATES AND PROPERTY VALUATION DATA DISPLAYED THROUGH
OUR SERVICES ARE NOT APPRAISALS AND ARE EXPRESSLY DISCLAIMED. SEE SECTION 5 (AUTOMATED VALUATION ESTIMATES) FOR THE FULL
AVM DISCLAIMER, WHICH IS INCORPORATED HEREIN BY REFERENCE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN
WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Consumer Review Authenticity (FTC Consumer Reviews Rule, 16 C.F.R. Part 302, effective October 21, 2024): Any reviews, ratings, or testimonials displayed on our Services are authentic and from verified users. Xome does not create, purchase, or incentivize fake reviews; does not suppress negative reviews; and requires disclosure of any material connection between Xome and a reviewer. AI-generated reviews are prohibited. First FTC enforcement actions under this rule were issued December 2025. Penalties: up to $53,088 per violation.
- Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL XOME, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES; OR (D) ANY BUGS, VIRUSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XOME’S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO XOME FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, FRAUDULENT MISREPRESENTATION, OR PERSONAL INJURY CAUSED BY NEGLIGENCE. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Governing Law and Dispute Resolution.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its
principles of conflict of laws. Any dispute, claim, or controversy arising out of or relating to these Terms or the use
of our Services that cannot be resolved informally shall be submitted to binding arbitration administered by JAMS under
its applicable rules, except that either party may bring an individual action in small claims court. THE PARTIES AGREE
THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN
ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitration shall take place in Dallas, Texas, or at a mutually
agreed location. Nothing in this section prevents either party from seeking injunctive or other equitable relief from a
court of competent jurisdiction where necessary to protect intellectual property rights or prevent irreparable harm.
Note: Certain state laws, including California law, may restrict the enforceability of class action waivers. Nothing in this arbitration provision limits any statutory rights you may have under applicable law. Consult legal counsel before agreeing if you have questions about these provisions.
New York Consumers: The New York FAIR Business Practices Act (signed December 19, 2025, amending N.Y. Gen. Bus. Law § 349) expanded New York UDAP protections to cover algorithmic pricing, drip pricing/junk fees, AI in consumer-facing tools, and automatic renewal subscriptions. New York consumers have additional rights under this law, including the right to bring actions against unfair AND abusive practices. Nothing in these Terms limits any rights New York residents may have under this statute.
- Indemnification. You agree to defend, indemnify, and hold harmless Xome and its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services.
- Modifications to Terms. We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days’ notice by posting the updated Terms on our websites and, where feasible, by notifying registered users via email. Your continued use of our Services after the effective date of any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically. The “Last Updated” date at the top of this page indicates when the Terms were most recently revised.

General Provisions.
Entire Agreement. These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Xome regarding the Services and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

NorthstarMLS End User License Agreement (EULA).
The following NorthstarMLS End User License Agreement (EULA) applies specifically to your access to MLS listing data provided by the Regional Multiple Listing Service of Minnesota, Inc. (NorthstarMLS). It applies only to users accessing Minnesota MLS listing data and supplements — but does not supersede — the main Terms of Use above. In the event of any conflict between this EULA and the main Terms of Use, the main Terms of Use shall govern, except with respect to matters specifically governed by MLS rules or Minnesota law, in which case this EULA shall govern to the extent required. This EULA is governed by the laws of the State of Minnesota notwithstanding the Texas governing law provision in Section 14 of these Terms with respect to MLS-specific matters.
The following terms and conditions govern all access to and use of NorthstarMLS listing content. You accept, without limitation or alteration, all the terms and conditions contained herein. THIS AGREEMENT IS A BINDING CONTRACT AND INCLUDES TERMS THAT LIMIT YOUR LEGAL RIGHTS AND LICENSORS’ LIABILITY TO YOU. CONSULT YOUR ATTORNEY BEFORE AGREEING IF YOU DO NOT UNDERSTAND ANY OF THE TERMS HERE.
This End-User License Agreement (“EULA”) is a legally binding contract between you; and the owner of this site, Xome Inc. (“Broker”); and Regional Multiple Listing Service of Minnesota, Inc., d/b/a NorthstarMLS and NorthstarMLS.com (“RMLS”); and the developer of this site, Xome Inc. (“Developer”). (Collectively, Broker, RMLS, and Developer are the “Licensors.”)
You seek access to real estate listings made up of factual information and creative content. Access to the listings is made available by the Licensors for your personal, non-commercial use only. Licensors own or administer the intellectual property rights, including the copyright, in the MLS database compilation, and no rights are granted to you by virtue of using this site, except as expressly stated in this EULA.
1. Scope. This EULA applies to your access to and use of real estate listing data provided through our Services that originates from NorthstarMLS.
2. License. Licensors grant you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Content solely for personal, non-commercial real estate search purposes.
3. Ownership. Licensors and their data providers retain all ownership and intellectual property rights, including copyright, in the Licensed Content and the Licensed Site.
4. Limited Use. You will not: (a) use the Licensed Content for any commercial purpose; (b) disclose Licensed Content to any third party except as necessary for your personal real estate transaction; (c) gather Licensed Content by any automated means; or (d) use the Licensed Content for any unlawful purpose.
5. License Revocation. Your license is immediately revoked without notice upon any breach of this EULA.
6. General Terms. This EULA is governed by the laws of the State of Minnesota. Any disputes arising under this EULA shall be resolved in accordance with Minnesota law. Each provision of this EULA is severable; if one provision is invalid, the remaining provisions remain in effect.
