Xome Inc. collects information about you when you use our mobile applications, websites, and other online services, including Xome.com, ValueYourHome.com (a Xome-powered automated valuation tool), and any other Xome digital products or platforms (collectively, "Services") and through other interactions or communications you may have with us or through our Services. Xome Inc. and its affiliates may be referred to collectively as "Xome," "we," or "us." This Privacy Policy applies to any user of our Services for any reason and anywhere in the world.

If you're a Xome customer and would like to submit a delete request, you may send an email to [email protected] with your full name and address, or by calling us toll-free at (800) 758-8052. If you're not a Xome customer, at most, we only have aggregated consumer data that cannot be reasonably linked to you or your household.

Please take a moment to read this Privacy Policy to understand how we collect, use, and share the information that we collect from or about you.

  1. What Information We Collect

    Information You Provide Directly

    When you use our Services, we collect a variety of information from you directly, including personally identifiable information. This information is obtained from your online registrations, searches, applications, surveys, or other forms you may complete. For example, when you register to use our Services, you provide us with certain personal information, such as your name, physical address, e-mail address, or phone number. If you register to participate in an auction event, we may collect additional information from you, including financial and credit information, as well as details about the properties you choose to bid on and your bidding patterns and history. You may also provide information about third parties, for example, if you share property listings with others via e-mail. Further, we may collect information about your transactions with our affiliates or others and may combine all information that is collected from or about you to create a profile about you.

    Information We Collect Automatically

    When you use our Services, we automatically collect certain information, including information about your device, browser, IP address, the pages you visit, and the features you use. We use cookies, web beacons, pixels, and similar tracking technologies to collect this information. When you use ValueYourHome.com, we additionally collect the property address or addresses you submit for valuation, the estimated values generated by our automated valuation model (the "Xome Valuation Model" or "XVM"), and your interaction with valuation results. See Section 3 (AI/ADMT Disclosure) below for additional disclosures regarding our use of automated decision-making technology in connection with property valuations. We may also collect geolocation data to improve the accuracy of property information presented to you.

  2. How We Use and Share Your Information

    We use information that we collect from or about you for business purposes including providing, maintaining, and improving our Services; processing transactions; sending you communications you have requested or that are relevant to your use of our Services; conducting research and analysis; preventing fraud; and complying with applicable laws and regulations.

    With Affiliated Companies

    We may share information about you with our affiliates for purposes related to our Services, including marketing and fraud prevention. We may share "eligibility information" (as defined under the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq.) with our affiliates for everyday business purposes. If you do not wish for our affiliates to use such eligibility information to market products or services to you, you may opt out by contacting us at [email protected] or by calling (800) 758-8052. This opt-out right is provided pursuant to the Fair Credit Reporting Act, 15 U.S.C. § 1681s-3 (Section 624).

    With Service Providers

    We may share information about you with service providers who perform services on our behalf, such as data analytics, marketing, technology services, fraud prevention, and customer support. These service providers are contractually required to keep your information confidential and may only use it for the purposes for which it was disclosed. We share with the following types of firms: accountants, auditors, couriers, consultants, information security, information technology, investors, marketing, and web and app developers. We also sometimes share with affiliates.

    With Government and Law Enforcement

    We may disclose your information when required by law, regulation, or legal process, or when we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Xome, our customers, or the public, or to respond to a government request, including law enforcement requests. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. In the event of a merger, acquisition, or other transfer involving all or part of our business, your information may be among the assets transferred.

    With Other Third Parties

    We may disclose some or all the information that we collect with non-affiliated companies or other organizations, including: financial service providers, such as mortgage bankers, title companies, and insurance agents; non-financial companies, such as retailers, direct marketers, membership clubs, and publishers; and other companies and organizations, including non-profit organizations.

    If you prefer that we not share such information about you with non-affiliates of Xome, you may opt out. That is, you may direct us not to share this information by: (1) calling us at (800) 758-8052; (2) sending a written inquiry to 8950 Cypress Waters Blvd, Coppell, TX 75019; (3) sending an e-mail to [email protected]; or (4) submitting an opt-out request through the "Do Not Sell or Share My Personal Information" link available on our websites. Please note that opting out of sharing with non-affiliates does not apply to sharing permitted by law or necessary to complete your requested transactions.

    SMS/Text Communications

    If you have provided your mobile phone number and consented to receive SMS or text messages from Xome, we use your phone number to send you service-related updates, property alerts, and, with your prior express written consent, marketing messages. For full details regarding our SMS communications program, including how to opt out, please see Section 11 (SMS/Text Messaging) of our Terms of Use, available at xome.com/pages/terms-of-use and valueyourhome.com/terms. Standard message and data rates may apply. You may opt out of SMS communications at any time by replying STOP to any message we send.

  3. Automated Decision-Making Technology and AI-Powered Valuations

    Xome uses automated decision-making technology in connection with certain Services, including ValueYourHome.com and the Xome Valuation Model (XVM). This section explains how that technology works and your rights in connection with it.

    What Is the Xome Valuation Model (XVM)?

    ValueYourHome.com is powered by the Xome Valuation Model (XVM), an automated valuation model ("AVM") that uses statistical and machine-learning algorithms to generate an estimated property value based on data inputs including property characteristics, comparable sales data, local market conditions, and public records. The XVM is Automated Decision-Making Technology ("ADMT") as defined under California law and similar state frameworks. Important: The XVM estimate is a tool for property research and valuation guidance only. It is not a real estate appraisal conducted by a licensed appraiser, and it should not be used as a substitute for a professional property appraisal. XVM estimates may differ from appraised values or actual sale prices. Xome does not guarantee the accuracy of XVM estimates, and users of ValueYourHome.com should not rely solely on XVM estimates for financial or investment decisions.

    Data Used by the XVM

    The XVM uses the following categories of data to generate valuation estimates: (1) the property address you submit; (2) publicly available property records (square footage, lot size, bedrooms, bathrooms, year built, property type); (3) recent comparable property sales in the surrounding area; (4) local real estate market trend data; and (5) geographic and neighborhood data. The XVM does not use your personal financial information, credit information, or protected class characteristics (such as race, national origin, sex, religion, or familial status) as inputs.

    Your Rights Regarding Automated Decision-Making

    California Residents (CCPA Automated Decision-Making Technology Rules, effective January 1, 2026): You have the right to opt out of the processing of your personal information by the XVM AVM for purposes of automated valuation. You also have the right to obtain a human review of an automated valuation result. To exercise these rights, contact us at [email protected] or call (800) 758-8052.

    Colorado Residents (Colorado AI Act, SB 24-205, effective June 30, 2026): If you are a Colorado resident and believe the XVM has produced a consequential decision affecting you, you may request a human review, correction of inaccurate data, and an explanation of the decision.     All Users: Regardless of your state of residence, you may contact us at [email protected] to request information about how an automated valuation for your property was generated, to correct inaccurate property data, or to request that we not use your submitted property address for purposes other than generating the valuation you requested.

    Federal AVM Quality Control Standards: ValueYourHome and XVM are subject to the federal Quality Control Standards for Automated Valuation Models (Dodd-Frank Act § 1473; 12 C.F.R. Parts 34, 225, 323, 748, 1005; effective October 1, 2025). Xome implements quality control standards to protect the integrity of valuation data, avoid conflicts of interest, and comply with applicable fair lending and fair housing laws, including the Fair Housing Act (42 U.S.C. § 3601 et seq.) and the Equal Credit Opportunity Act (15 U.S.C. § 1691 et seq.).

    FTC Policy Statement on AI (March 11, 2026): The Federal Trade Commission has issued a policy statement clarifying that Section 5 of the FTC Act (15 U.S.C. § 45) applies to AI systems across their lifecycle. Xome complies with this framework by: (1) making truthful and substantiated claims about XVM capabilities and accuracy; (2) disclosing material limitations of AVM estimates; (3) not presenting AI-generated valuations in ways that could mislead consumers; and (4) implementing safeguards against discriminatory outputs.

    General AI disclosure: "This tool uses artificial intelligence and automated analysis. AI systems have limitations and may not capture all property-specific factors. Results should be verified independently."

    Texas Residents (Texas Responsible AI Governance Act, TRAIGA, effective January 1, 2026): If the XVM is used in connection with a consequential decision affecting a Texas resident, Xome will provide disclosure of the AI system's role and your right to request human review.

    Maine Residents (Maine LD 2271, effective September 23, 2025): If you interact with an AI-powered chatbot or automated assistant on our Services, we will disclose that you are communicating with an automated system and not a human representative.

    Georgia Residents (Georgia HB 478, effective July 1, 2025): AI-generated content used in commercial contexts on our Services is identified as AI-generated.

    California Real Estate Listings (California AB 723, effective January 1, 2026): When property listing images displayed on Xome.com or ValueYourHome.com have been digitally altered (e.g., AI-added or removed furniture, landscaping, structural elements), we require listing brokers to disclose the alteration and provide access to unaltered original images.

    Note: HUD's May 2024 guidance documents on AI and fair housing were rescinded in September 2025. Xome's fair lending and non-discrimination commitments are grounded in the Fair Housing Act (42 U.S.C. § 3601 et seq.) and ECOA (15 U.S.C. § 1691 et seq.) as statutes, which remain fully in effect regardless of agency guidance.

    Federal AI Preemption (Executive Order 14365, December 2025): The federal government has directed federal agencies to establish a unified national AI policy framework and evaluate state AI laws for potential preemption. The regulatory landscape for state AI transparency requirements is evolving. Xome monitors these developments and will update its practices as federal guidance is finalized.

    California SB 942 (AI Transparency Act, effective August 2, 2026): Beginning August 2, 2026, AI-generated content served to California users on our platforms will include visible disclosure labels and embedded watermarks identifying it as AI-generated.

    Fair Lending and Non-Discrimination

    Xome is committed to ensuring that XVM estimates do not reflect or perpetuate unlawful bias or discrimination. The XVM is designed and validated to avoid disparate impact on protected classes under the Fair Housing Act and applicable state fair housing laws. Xome conducts ongoing bias monitoring and disparity testing of the XVM across protected class groups and updates the model to address any identified issues.     3rd-Party AVM Supplements

    Where the Xome Valuation Model (XVM) does not have sufficient data to generate a reliable estimate for a specific property, Xome may display a valuation estimate sourced from a purchased third-party automated valuation model (AVM) provider. Third-party AVM estimates are subject to the same disclaimer language as the XVM: they are not appraisals, are provided on an "AS AVAILABLE" and "AS IS" basis, and should not be relied upon as a substitute for a professional property appraisal. Third-party AVM providers are contractually required to meet applicable quality control standards consistent with the federal AVM QC Standards Rule (Dodd-Frank Act § 1473; effective October 1, 2025).

  4. Targeted Advertising and Tracking Technologies

    We may use technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). We believe that online behavioral tracking helps provide you with more relevant advertising based on the websites you visit. Third parties, including advertising networks and analytics providers, may also use similar technologies to collect information about your online activities over time and across different third-party sites, including your use of our Services. The tracking technologies we and our partners use include: cookies (small text files stored on your device); pixel tags and web beacons (small electronic files embedded in web pages or emails); device fingerprinting technologies; and JavaScript tracking tags.

    You can visit the NAI Opt-Out website for information on how you can opt out of behavioral tracking on our Website. Using the choice mechanisms these programs make available may help you see advertising that is relevant to you or help you avoid seeing interest-based advertising generally. Please note that our Services honor "Global Privacy Control" (GPC) signals. If you transmit a GPC signal from your browser or device, we will treat it as a valid opt-out of the sale and sharing of your personal information for cross-context behavioral advertising.

    Sensitive Personal Information. If any of our advertising or targeting activities involve the use of sensitive personal information as defined under California law (including precise geolocation data), you may use the "Limit the Use of My Sensitive Personal Information" link on our websites to restrict our use of such information to purposes permitted by law.

    We use a Cookie Preference Manager on our websites that allows you to control which categories of cookies are active on your device. The Cookie Preference Manager covers at minimum the following categories: Strictly Necessary, Analytics/Performance, and Marketing/Targeting cookies. Although you may not opt out of receiving cookies that are strictly necessary for the operation of our Services, you may opt out of other non-essential cookies through the Cookie Preference Manager or your browser settings.

  5. How We Protect Your Information

    We have implemented physical, electronic, and procedural safeguards designed to protect the personal information we collect and maintain. Our information security program is designed to be consistent with applicable federal and state data security requirements, including the FTC Safeguards Rule (16 C.F.R. Part 314) and applicable state data security laws. However, no security system is impenetrable, and we cannot guarantee the absolute security of your information.

    Data Breach Notification. In the event of a security incident that compromises the security, confidentiality, or integrity of your personal information, Xome will notify you and applicable regulatory authorities as required by applicable federal and state data breach notification laws, which vary by state. Residents of states with specific breach notification timelines will be notified consistent with those requirements. Residents of Puerto Rico will be notified consistent with Puerto Rico Act 111-2005, which requires notification to the Puerto Rico Department of Consumer Affairs (DACO) within 10 days.

    FTC Safeguards Rule Breach Notification: If a security incident involves the unauthorized acquisition of unencrypted customer information of 500 or more consumers, Xome will notify the Federal Trade Commission within 30 days of discovery, in accordance with the FTC Safeguards Rule (16 C.F.R. Part 314), as updated effective 2024. This notification obligation is in addition to, and does not replace, state breach notification requirements.

  6. Maintenance of Accurate Information

    We have established commercially reasonable procedures designed to ensure that your personal information is as accurate and complete as possible. If you believe that our records contain inaccurate or incomplete information about you, please notify us by calling (800) 758-8052, sending a written inquiry to 8950 Cypress Waters Blvd, Coppell, TX 75019, or by sending us an email to [email protected]. We will take commercially reasonable steps to investigate your concerns and correct inaccurate information in a timely manner.

    Property Record Removal Requests: Xome receives and displays property information sourced from publicly available local taxing and property records from county assessors and recorders' offices throughout the nation. Because this information is publicly available data, Xome does not remove individual property records from its platform upon request. If you believe property data displayed on our Services is erroneous, the most effective way to correct it is to contact your local property assessor or recording office directly — in many cases, the same information can be viewed online through your local assessor's or recorder's website. Once corrected at the source, Xome's data will update in the ordinary course of our data refresh cycle.   7. Other Websites

    Our websites may contain hyperlinks to other Internet sites. While we try to link only to sites that share our high standards and respect for privacy, we are not responsible for the content or the privacy practices employed by other sites. These other websites may collect and share data in a manner that is not consistent with our privacy practices. You should review the privacy policies of any other websites you visit.

  8. Do Not Sell or Share My Personal Information

    Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) (Cal. Civ. Code § 1798.100 et seq.), California residents have the right to opt out of the "sale" and "sharing" of their personal information. For purposes of this section:

    "Sale" means the disclosure of your personal information to a third party for monetary or other valuable consideration.

    "Sharing" means disclosing your personal information to a third party for cross-context behavioral advertising, regardless of whether money changes hands.

    To exercise your right to opt out of the sale or sharing of your personal information, you may: (1) click the "Do Not Sell or Share My Personal Information" link available in the footer of each of our websites; (2) submit a request at [email protected]; or (3) call us at (800) 758-8052. We will also honor valid Global Privacy Control (GPC) signals as opt-out requests. We will not discriminate against you for exercising your opt-out rights.

    Note for Users of ValueYourHome.com: The property address and valuation data you submit through ValueYourHome.com may be used to improve our AVM model and may be shared with affiliated companies. To opt out of such use, please contact us at [email protected].

    Cookie Preference Center / OneTrust Opt-Out: In addition to the methods above, you may exercise your right to opt out of the sale and sharing of your personal information through the OneTrust Cookie Preference Center available on our websites. A cookie consent banner will appear on your first visit; you may also access the Preference Center at any time by clicking the cookie icon located in the bottom-left corner of any page on Xome.com or ValueYourHome.com. Through the Preference Center, you can manage your consent for Analytics/Performance and Marketing/Targeting cookie categories. Strictly Necessary cookies cannot be disabled as they are required for the operation of our Services.

  9. Changes to This Privacy Policy

    We may revise this Privacy Policy from time to time as we deem necessary. Any material changes to this Privacy Policy will be posted on this webpage and, where required by applicable law, we will provide notice to affected users prior to the changes taking effect. The effective date at the top of this Privacy Policy indicates when it was last updated. Please review this webpage on a regular basis to remain informed about the most recent terms of our Privacy Policy.

  10. Acceptance of Privacy Policy Terms

    Your ongoing use of our Services constitutes your acceptance of this Privacy Policy, including any changes to the Privacy Policy following the posting of such changes. If you do not agree with this Privacy Policy, please do not use our Services.

  11. Children Under 13 Years of Age

    Pursuant to Xome's Terms of Use, use of our Services by children under the age of 13 is prohibited. Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Consistent with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq., and the FTC COPPA Rule (16 C.F.R. Part 312), we do not knowingly collect, use, or disclose personal information from children under 13 years of age. If a child under the age of 13 has provided personal data to us, we encourage the child's parent or guardian to contact us as described in this Privacy Policy, and we will take prompt steps to delete such information from our records and remove such information as quickly as possible.

  12. California Consumer Privacy Act (CCPA / CPRA) Disclosures

    If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA) (Cal. Civ. Code §§ 1798.100 et seq.), provides you with the following rights:

    • The right to know what personal information we collect, use, disclose, and sell or share.
    • The right to access your personal information.
    • The right to request deletion of your personal information, subject to certain exceptions.
    • The right to correct inaccurate personal information.
    • The right to opt out of the sale and sharing of your personal information (see Section 8 above).
    • The right to limit the use and disclosure of sensitive personal information.
    • The right to non-discrimination for exercising your privacy rights.
    • The right to opt out of automated decision-making technology (see Section 3 above).

We will respond to verifiable consumer requests within 45 days, extendable by an additional 45 days when reasonably necessary. Information we collect, store, or share in connection with providing you a financial product or service may be exempt from certain rights under the CCPA. Likewise, information we collect about individuals acting on behalf of a business may also be exempt.

  13. Nevada Residents

    Nevada law (Nev. Rev. Stat. § 603A) provides Nevada residents the right to opt out of the sale of their personal information. We do not currently sell personal information as defined under Nevada law. However, if you are a Nevada resident and would like to submit a verified opt-out request, please contact us at [email protected].

  14. Additional U.S. State Privacy Disclosures

    If you are a resident of one of the following states, you may have additional privacy rights under applicable state law. The rights described below apply to residents of each listed state as of the effective date indicated:

    Note – Maryland Residents (MODPA): The Maryland Online Data Privacy Act is one of the most restrictive state privacy laws currently in effect. Maryland law prohibits the collection of sensitive personal information unless such collection is strictly necessary for the service. Xome complies with this restriction by limiting collection of sensitive data to only those purposes strictly necessary to provide our Services.

    Rights Available in the States Listed Above

    • The right to confirm whether we are processing your personal information, and to access your personal information.
    • The right to correct inaccurate personal information we hold about you.
    • The right to request deletion of personal information you have provided or that we have collected about you, subject to certain exceptions.
    • The right to obtain a portable copy of the personal information you have provided to us in a readily usable format.
    • The right to opt out of the processing of your personal information for purposes of: (a) targeted advertising; (b) the sale of personal information; and (c) profiling in furtherance of automated decisions that produce legal or similarly significant effects.

    We collect information about our customers to conduct our business. For example, we typically collect name, phone number, email address, mailing address, approximate location, technology habits (e.g., what browser you use, whether you are using a tablet or mobile phone, and internet activity), and commercial information such as the products or services you've purchased from us. We collected most of this information directly from you – either when you provided it to us directly or through your interactions with our Services.

    Right to Appeal. Depending on your state of residence, you may have the right to appeal our decision to refuse to act on your request. We will respond to your appeal within the timeframe required by your state's law. If your appeal is denied, and you are a resident of a state with a designated regulatory body for privacy appeals (such as the Colorado Attorney General's Office), you may submit a complaint to that body.
